Snapcard Terms of Service and Conditions of Use

Welcome to Snapcard! These Terms of Service and Conditions of Use ("Terms") govern your access to and use of the Snapcard mobile application ("App") provided by IWYNO FINWORKS LLC dba QWYK iSoft ("QWYK," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
Additional terms may apply to specific features or plans ("Specific Terms"). If there’s a conflict between these Terms and any Specific Terms, the Specific Terms will prevail.
1. Acceptance of Terms
By using Snapcard, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy (available at https://qwyk.4xn.in/privacy). These Terms form a legally binding agreement between you and QWYK iSoft.
2. Description of Services
Snapcard is a mobile application designed to help individuals and small businesses create, manage, and share digital business cards, build personal networks, and nurture relationships. Our Services include QR code-based contact sharing, smart reminders, proximity alerts, and other networking tools. We reserve the right to modify, suspend, or discontinue any part of the App at any time without notice.
3. User Responsibilities
You agree to use Snapcard only for lawful purposes and in accordance with these Terms. You are responsible for:
- Ensuring your use complies with all applicable laws and regulations.
- Maintaining the confidentiality of your account credentials.
- Any content, data, or materials you upload, such as contact notes or tags.
- Granting necessary permissions (e.g., location access) for full functionality, such as proximity alerts.
QWYK is not responsible for third-party content, applications, or services that interact with Snapcard.
4. Intellectual Property
All intellectual property rights in Snapcard, including software, designs, logos, and documentation, are owned by QWYK or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal or small business networking purposes, subject to these Terms.
You may not:
- Reverse engineer, decompile, or disassemble the App.
- Modify, distribute, or create derivative works without our express written consent.
- Use Snapcard in any way that infringes on QWYK’s or third-party rights.
Any user-generated content you provide (e.g., contact details, notes) remains yours, but you grant QWYK a non-exclusive, worldwide, royalty-free license to use, store, and display it to provide the service.
4.1 Third-Party Services and Payment Processors
Snapcard may include links to, or integrations with, third-party services, such as payment processors (e.g., Apple, Google, Stripe, or our authorized affiliates). You acknowledge that:
- These third-party services are governed by their own terms and privacy policies.
- We are not responsible for the content, functionality, accuracy, or availability of third-party services.
- Payments are processed by these third parties on our behalf. We do not store or process your credit card or banking information directly.
- We are not liable for any issues, disputes, or losses arising from transactions with third-party processors.
5. No Warranty; Limitation of Liability
5.1 No Warranty
Snapcard is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or free of viruses.
5.2 Limitation of Liability
To the fullest extent permitted by law, QWYK is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising from your use of Snapcard. Our total liability to you for any claim related to these Terms or the App shall not exceed the amount you paid us for the service in the past 12 months. If no payment was made (e.g., Free Plan), our liability is limited to $100.
QWYK shall not be liable for damages caused by:
- Bugs, errors, or interruptions in the App.
- Your use of Snapcard with third-party software or services.
- Your failure to update or maintain your device.
5.3 No Professional Advice
Snapcard is intended solely for personal and professional networking. We do not provide legal, financial, employment, or any form of professional advice. Any insights or nudges generated by the App are for informational purposes only and should not be construed as actionable recommendations.
5.4 Data Loss
We strive to maintain availability and integrity of your data, but we do not guarantee against data loss. You are responsible for regularly backing up important information. We are not liable for any loss or corruption of data stored in or transmitted through Snapcard.
6. Indemnification
You agree to indemnify, defend, and hold harmless QWYK, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees, arising from your use of Snapcard, your violation of these Terms, or your infringement of any third-party rights.
7. Payments and Subscriptions
Some Snapcard features require a paid subscription (e.g., Pro, Team & Enterprise Plans). Payment terms, cancellations, and refunds are detailed in the App and on our website (https://snapcard.4xn.in). Prices may change with notice, and all payments are non-refundable except as required by law. Payments may be processed through third-party providers or authorized affiliates.
8. Termination
We may terminate or suspend your access to Snapcard at any time, with or without cause, and with or without notice, if you violate these Terms or for operational reasons. You may stop using the App at any time by deleting it. Upon termination, your license ends, and you must delete all copies. Provisions that by their nature should survive (e.g., intellectual property, liability) will remain in effect.
9. Governing Law and Dispute Resolution
These Terms are governed by and construed under the laws of the State of Texas, without regard to its conflict of laws principles. Any disputes will be resolved through binding arbitration in Austin, Texas, per the American Arbitration Association rules. You waive any right to a jury trial or class action.
10. Changes to These Terms
We may update these Terms at any time. If we make material changes, we’ll notify you via email, in-app notification, or on our website. Your continued use of Snapcard after updates constitutes acceptance of the new Terms.
11. Force Majeure
QWYK shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including but not limited to acts of God, labor disputes, internet failures, power outages, governmental actions, or natural disasters.
12. Export Control and Legal Compliance
You represent that you are not located in a country that is subject to U.S. government export restrictions or identified on any U.S. government sanctions list. You agree to comply with all applicable laws regarding your use of Snapcard.

14. Severability and Waiver
If any provision of these Terms is invalid, the remaining provisions will remain in effect. Our failure to enforce any right does not waive our ability to enforce it later.
15. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and QWYK regarding your use of Snapcard.
